Facing The Reality Of Divorce

When a marriage ends, the emotional and financial stress can become almost unbearable. Dividing Your Marital Property

In divorce proceedings, Minnesota is an equitable distribution state. This means that rather than simply dividing all the marital property in half, the judge divides your property based on what is fair for you and your spouse. There are many factors that influence how property is divided, including:

  • Child custody arrangements and disputes
  • How marital debt is distributed
  • Financial standing of each spouse
  • The length of the marriage

In some instances, the court may order the sale of a marital asset such as a home or a business in order to divide the assets fairly. The goal of the court is not to make either of the spouses happy, but to divide assets in a way that is fair and equitable. To avoid selling a property or business against your will, we recommend mediation or another alternative divorce resolution, so the judge is not the one making these decisions.

Child Support And Child Custody

With the exception of situations where abuse is involved, we believe both parents should be involved in raising children. We will negotiate with your spouse to create a custody arrangement that is in the best interests of your children and agreeable to you and your spouse. Once a custody arrangement is established, child support payments are negotiated based on time spent with each parent, the income of each spouse, and the basic financial and medical needs of each child.
